While there is no report on whether alcohol was involved in this tragedy, if you've ever owned a boat you probably know that you're not throttling up a boat in the dark if you're sober. Boating in the dark is kind of scary; you're more likely moving along at 10mph with your spotlight on the water in front of you.
Initial reports said that the boat was not owned by Fernandez, but we've since learned that it was, in fact his boat. It's likely that he was in fact driving the boat when the accident occurred. Text messages from one of the friends urged him not to get onto the boat.
Toxicology reports showed that Fernandez had a Blood Alcohol ratio of between .147 and .160, almost double the legal limit. Legal limits aside, .147 equates to "blasted". You shouldn't be driving anything with that much alcohol in your system
